August Date Set For Lowe’s Appeal Court Hearing
Sonora, CA — Wednesday, August 29th; according to Sonora City Administrator Greg Applegate that´s the day a three judge panel at the Fifth Circuit Court of Appeals in Fresno will hear oral briefs on the proposed Lowe´s Home Improvement Center project.
The oral arguments will be limited to the record submitted by the attorneys representing the city, California Gold Development Corporation and the Tuolumne County Citizens for Responsible Growth. The judges will then be allowed to ask questions pertaining only to material included in the record.
Applegate stressed that the city and the developer have requested a quick turnaround for a decision.
The Tuolumne County Citizens for Responsible Growth filed their appeal in October, 2006 regarding an August 21, 2006 decision handed down by Tuolumne County Superior Court Judge James A. Boscoe that found in favor of Sonora and California Gold Development Corporation in their efforts to build a Lowe´s store west of Old Wards Ferry Rd.
