In a recent decision the Supreme Court invalidated the Securities and Exchange Commission system used to seek civil fraud penalties. Claiming that it violated their Seventh Amendment right to a jury trial Chief Justice Roberts wrote: “A defendant facing a fraud suit has the right to be tried by a jury of his peers before a neutral adjudicator.” Meanwhile, the Biden administration had warned that such a decision would threaten agencies across the federal government with similar structures including the Federal Trade Commission, the IRS, the Environmental Protection Agency and the National Labor Relations Board. And to that, we say “good!” It’s about time these unelected bureaucrats with an agenda were reined in.
