Judge Denies County’s Trinitas Motion

San Andreas, CA – A bankruptcy judge recently denied a motion by Calaveras County to dismiss a case filed by owners of the Ridge at Trinitas golf course in Wallace.

The owners Mike and Michelle Nemee are requesting declaratory relief from the county in Federal Bankruptcy Court.

Mike Nemee has stated that the county encouraged them to continue construction of the 18 hole layout south of Wallace and even sent a county employee to help them secure a $2.4 million loan from the Community Bank of San Andreas.

The county hoped to have the case dismissed, but Judge Ronald Sargis wrote in a decision, “The Motion to Dismiss filed by Calaveras County is denied with respect to claims for declaratory relief and global estoppel.”

The case is being heard in the U.S. Bankruptcy Court Eastern District of California. A pretrial conference is scheduled for January of 2011.

The Nemee’s would also still like to have their property approved for agritourism activity, after the idea was voted down by the county in October of last year.
