Stayner Files Motion To Throw Out Three Charges

A lawyer for Yosemite killer Cary Stayner has filed a motion to dismiss three charges that could bring the death penalty in his triple murder trial.
Defense lawyer Marcia Morrissey says evidence doesn´t support robbery, burglary and kidnapping allegations linked to the February 1999 killing of three tourists. The so-called special circumstances could bring the death penalty if Stayner is convicted.
