The man charged with killing nine of his children is due back in court today.

Marcus Wesson was due be to arraigned yesterday, but appeared in court without a lawyer. The judge ordered Wesson to return today with an attorney, or accept legal representation by the state.

The 57-year-old Wesson has been charged with nine counts of murder and could be sentenced to death if he´s convicted. The victims include children ages one to 17, as well as his 25-year-old daughter, who was the mother of one of the infants killed.

Meanwhile, Fresno Police Chief Jerry Dyer has acknowledged that his department is looking into whether Wesson shot his children while police waited outside his house.

Police haven´t said exactly when the victims died or what kind of gun was used, and the coroner´s office was still preparing its report that could answer those questions.
