Sacramento, CA -- Legislation that would ban smoking at state parks failed to get enough needed votes in the Assembly Thursday.

The Associated Press reports that SB 4 stalled over objections from some lawmakers that it would inappropriately punish smokers.

The legislation would ban smoking at all state parks and state beaches as a way to eliminate unsightly cigarette butts and secondhand smoke.

The bill in the 80-member Assembly fell five votes short of the simple majority needed to approve the ban, in part because several lawmakers who were expected to vote for it were absent. Lawmakers say it could come back up for a vote as early as Monday. It has already been approved in the Senate.
