Judge Denies Dismissal

Sonora, CA — A judge has denied a request to dismiss charges filed against four workers at a Tuolumne County marijuana collective.

Today Judge Douglas Boyack denied the demurrer request made on behalf of Sara Herrin, Danny Herrin, Nancy Smith and Jana Evans. The four were arrested when Today’s Health Collective off Via Este was raided by authorities last May. The attorneys for the defendants argued that all four are medicinal marijuana patients and were acting in compliance with the state’s laws regulating medicinal marijuana use. In denying the request, the case will now likely go to a jury trial.

The next step in the legal process is a preliminary hearing that has been scheduled for October 12th at 1:15pm in Department Four of Tuolumne County Superior Court.

On a related note, the judge will hear a request to dismiss charges filed against the workers at Foothill Care Collective on Mono Way next Tuesday in Tuolumne County Superior Court.
