Judge Rules A Rehire Of LAPD Police Officer

A Superior Court judge is overturning the firing of a policeman who was dismissed after his disgraced partner said the officer knew marijuana had been planted on a suspected gang member.

Officer Humberto Tovar was the first person fired as a result of Rafael Perez´s allegations that officers at the LAPD´s Rampart station routinely abused the rights of residents.

Perez told investigators he planted marijuana on a suspected gang member in 1996 with the knowledge of Tovar, who was his partner at the time.

Tovar appealed his August 2000 firing by claiming that the evidence did NOT support a finding of guilt and that Perez was not credible.

A judge last week ruled in his favor and ordered the police department to rehire him.
