New Charges in SFPD Assault Case

Prosecutors in the assault case involving three off-duty San Francisco police officers have withdrawn three indictments and filed a new set of modified charges.

District Attorney Terence Hallinan says the new charges will include assault with a deadly weapon and two alcohol-related counts: public drunkenness and drunken driving.

Hallinan says he had to file a new complaint because he could not amend the original grand jury indictments that implicated the rookie officers.

Alex Fagan Junior, Matt Tonsing and David Lee are accused of attacking two men over a bag of steak fajitas outside a restaurant in November.

The three defendants are scheduled to be arraigned this morning. Hallinan has requested a preliminary hearing within the next two weeks.
