It´s the latest twist to the California recall election. In an unusual step, the federal appeals court that postponed the October seventh election signaled Tuesday that it may be willing to reconsider.

The Ninth U.S. Circuit Court of Appeals asked California election officials and recall proponents to file briefs by Wednesday afternoon. At issue is whether they want an eleven-judge panel to reconsider Monday´s postponement ruling by a three-judge panel.

The three-judge panel ordered a delay in the vote because six California counties still use punch-card ballots — the same system that sent the 2000 presidential race into chaos.

A spokeswoman says California´s Secretary of State Kevin Shelley plans to file a brief tomorrow asking the Ninth U.S. Circuit Court of Appeals to reinstate the October 7th election date.
