CalCo Supervisors Deny Airola Claim

We told you Saturday morning that the victim´s mother in a fatal Calaveras County wreck has filed wrongful death charges against the teen who was behind the wheel that night in 2003.

Now, a claim by that driver that a Sheriff´s deputy acted negligently has been denied by the Calaveras County Board of Supervisors.

The claim was that deputy Tracy Busby should have made sure that teenagers, caught drinking at a party, were sober before sending them driving home.

Calaveras County Sheriff Dennis Downum is quoted as saying Busby acted correctly.

Driver Zachary Airola was behind the wheel of his pickup that night when it rolled over and hit a tree, killing 19-year-old George Langston.

Airola was later found to have a blood alcohol level of .18, more than twice the legal limit.

He pleaded no contest in April to two counts of DUI manslaughter.

The woman who held the party, Stephanie Schuler, was fined 600 dollars for allowing a minor to drink alcohol.
