Liability Questioned In Death Of Yosemite Climber

Yosemitre National Park, CA — Lawyers for a climber killed by a rock fall in Yosemite National Park argued this morning in Fresno federal court that the National Park Service should be held financially liable for the mans death.

The lawyers claim park rangers did not warn the public of potential danger in the area. The Park Service´s lawyer says Yosemite has immunity in such civil lawsuits because Congress gave park rangers discretion when to warn the public of potential dangers.

Peter Terbush died in 1999 when he was killed by a falling rock east of Curry Village. At issue is whether Terbush´s parents can move forward with their $10 million wrongful-death lawsuit against the Park Service.
