Death Penalty Possible in Jamestown Murder Case

Prosecutors could seek the death penalty in the case of two men charged with murder and attempted murder in a Jamestown shooting in January.

27 year old Steven Myers and 20 year old Derek Wooden have both pleaded not guilty.

34 year old Donald Hopkins and 29 year old Melissa Berry were both shot in their Jamestown apartment where they lived together. Hopkins died, Berry survived.

California´s felony murder rule allows for capital punishment to be imposed in cases where a death occurs during another felony, like armed robbery.

Prosecutors believe the murder of Donald Hopkins occured while Myers and Wooden were robbing Hopkins and Berry of some drugs and cash.
