Homeowners Association Foreclosures Reevaluated

Should homeowners associations have the power to foreclose on houses? That´s the subject of a debate going on in Copperopolis, after an elderly couple who failed to make a 120-dollar dues payment had their house sold at auction for a fraction of its assessed value.

Tuesday, the state Senate held a hearing on homeowners association foreclosure. Senator Rico Oller spoke out on the issue, saying that the association´s action was “unconscionable” and a “ridiculous exercise of power”.

Oller also said that the laws governing such actions need to be changed, but an associations spokesman said that limiting their options without a study would be a mistake.

There´s still no word on a final outcome in the case of Thomas and Anita Radcliffe.
