Attorneys for Cary Stayner plan to mount an insanity defense today in a San Jose courtroom in an attempt to save the former handyman´s life. Stayner was convicted Monday of murdering three Yosemite National Park tourists in 1999. Yesterday defense lawyers lost their bid to bar psychiatrist Doctor Park Dietz from testifying in the sanity phase. Dietz testified in the high-profile cases of the Unabomber and the would-be assassin of President Reagan. The judge rejected the defense´s argument that Dietz should not be allowed to testify because he´s not licensed to practice medicine in California. The same panel that convicted Stayner of first-degree murder now must decide if he was sane at the time. If the jury finds him sane, they will then decide whether he receives the death penalty.
