Nineteen people who were aboard a Metrolink commuter train that collided with a freight train in April have filed a civil lawsuit against both train operators. The lawsuit, filed in Orange County Superior Court, claims negligence and willful misconduct by both Metrolink and Burlington Northern Santa Fe. It alleges the railway´s warning signal was inadequate and that officials were aware of the dangers. The action follows a similar lawsuit filed in Los Angeles Superior Court earlier this month. Two people were killed and more than 200 were injured when the freight train collided with the Metrolink train April 23 in Placentia.
Investigators believe the crash was caused when the freight train ran two warning signals. The freight engineer told police he was blinded by the sun and missed a crucial signal light.
