Central Valley voters are challenging a ballot measure that would limit the stateÂ´s ability to ask citizens about their race. Opponents of the Proposition 54 have filed a lawsuit alleging voting rights violations in Kings and Merced counties.
The plaintiffs are being represented by the Mexican American Legal Defense and Educational Fund.
They argue that putting Proposition 54 on the ballot to recall Governor Davis violates the federal Voting Rights Act. The proposition was originally set for the March presidential primary, but was moved to October 7 when the recall qualified. It would ban state and local governments from using or collecting racial and ethnic information.
The lawsuit asks a three-judge panel to push the ballot measure back to March.
