California cows may or may not be as happy as those California Milk Advisory Board ads claim – but it´s not a subject for a lawsuit.
San Francisco Superior Court Judge David Garcia yesterday dismissed a suit filed by People for the Ethical Treatment of Animals. PETA´s suit accused the milk board of false advertising. They claim the life of a California cow is far from the idyllic portrait in the ads. PETA says the cows in fact live in dirty mud holes with little or no vegetation.
Garcia ruled that since the ads are produced by a government agency – they don´t violate state laws against false advertising. PETA attorney Matthew Penzer concedes the government should be exempt from such laws in rare cases. He says this isn´t one of them. He says he´s not sure what PETA´s next steps will be.
