Appeals Court Considers Whether Redistricting Measure Goes On Ballot
Sacramento, CA — An appeals court in Sacramento is debating whether Governor Schwarzenegger´s redistricting initiative should go to voters.
The 3rd District Court of Appeal heard arguments today on an attempt to overturn a Sacramento judge´s order that removed the redistricting proposal from the ballot.
The proposal would take the power to draw legislative and congressional districts away from the Legislature and give it to a panel of retired judges.
The measure ran into legal problems after supporters said they had inadvertently used two versions of the initiative during the qualification process.
One version went on voter petitions and another was submitted to the attorney general´s office for preparation of a title and summary to go on the petitions.
The attorney general says that violated a clear-cut constitutional requirement that the same version of the initiative sent to the attorney general´s office be used on petitions.
