Convicted Murderer Denied Parole

Rancho Calaveras, CA — A man who killed three people in Rancho Calaveras in 1986 was denied parole yesterday.


67-year-old Francisco Rubio was found guilty over two decades ago of killing 33-year-old David Miller, 36-year-old Donna Miller and 37-year-old Dennis Weibe. The shootings happened at a home that was under construction. Rubio went to the residence trying to steal dynamite in order to settle a drug debt. The people at the home had refused to give Rubio the dynamite, which led to the shootings. The Millers four year old daughter and Weibe’s 17-year-old son were at the scene, but were not harmed. Rubio was also with his former wife Mary Rubio and acquaintance Derek Gutierrez.


Rubio appeared before the state parole board for the fifth time yesterday to argue for his release, but the board decided he still poses an unreasonable risk to public safety. Calaveras County District Attorney Barbara Yook appeared at the hearing.


“Three people were murdered in front of their children, and until he takes responsibility for his actions, his expressions of remorse are hollow,” says Yook. “We fought to keep him locked up because we believe he still poses a danger to society.”


The hearing was held in Vacaville. His release was denied for at least three years. Rubio is serving a life sentence with the possibility of parole.
