Eleven Judges Will Re-hear Recall Arguments

California´s election in which voters consider removal of Governor Gray Davis got a new legal delay and added uncertainty today. A federal appeals court in San Francisco has decided a panel of eleven of its members will re-hear arguments Monday at 1 p.m. on the issue of postponing the October seventh voting.

Three of the Ninth Circuit Court of Appeals members have ruled that flaws in old-style voting systems in six California counties merit the postponement. Any decision the eleven judges make is likely to be appealed to the U.S. Supreme Court.

That would continue the legal snarl stemming from the effort to recall Democratic Governor Gray Davis.

If the decision of the three-judge panel stands the voting on removal of Davis and a vote on candidates to succeed him if he is recalled — could be delayed until the state´s primary election on March second of next year.
