Court: Disabled Workers in California Better Protected

Sponsored by:

The California Supreme Court has ruled that state workplace disability laws offer employees greater protections than similar federal rules.

The unanimous decision said today that the California Legislature has granted more rights to the disabled than the federal Americans with Disabilities Act. The justices say the state´s lower courts may have been confused by a recent state law. That law clarified that the Golden State gives workers greater protections than the A-D-A. The justices say the lower courts may have wrongly dismissed some disability cases.

Today´s decision means some injured workers whose suits were dismissed might be able to get the courts to look at their lawsuits again.
