Authorities have arrested a 21-year-old Modesto man and charged him with 5 counts of attempted murder after he ran his car off the road and into a group of teenagers.

Marcos Rodriguez, an admitted Sureno street gang member, will also be charged with a gang enhancement in the case.

According to authorities, the five boys, between 9 and 16 years old, were

walking northbound on Tucson Avenue when Rodriguez struck them from behind.

Three of the boys were treated and released from local hospitals.

One boy was taken by helicopter to UCSF where he was in critical condition.

“We were not sure if he was going to survive the head injuries,” said Sheriff´s Detective Frank Navarro. “His condition has since been upgraded to stable and it appears that he is going to be OK.”

Upon questioning Rodriguez, detectives learned that he had had previous problems with one of the victims and was out for revenge. In his car they also found a metal pipe and a knife.

In addition to the attempted murder and gang enhancement charges, Rodriguez will also be charged with assault with a deadly weapon and driving under the influence after a blood alcohol test showed that he was .14.

The legal limit is .08.
