Go into a cheap shoe store, steal cheap shoes with a tattoo on your face to make identification easier. Will the stupidity of criminals ever cease?

So shop lifting is a felony burglary? Come on....this is Payless Shoes, how much was that one pair shoes worth to make it a felony?

I thought felonies involved larger sums of money?

To everyone reading, Interfaith helps indigent and homeless people. All these guys had to do was go down, sign up and ask for shoes and they would have received those shoes. They also offer hot showers, household items, food and clothing.

That means homeless..or living with their friends.
Arresting people like this, and letting them go...will NOT fix this problem.

Good question onward. Unless the "robbery" was committed by force I don't see how 3 pairs of shoplifted shoes could justify a felony charge.

Petty theft is cash or goods valued under $400, grand theft is over $400. Three pairs of shoes from Payless are not worth $400...

No act of theft is needed to commit a burglary. Burlary is a specific intent crime. Look up sections 459-460 of the penal code and all subsections inbetween.

Intent to commit a misdemeanor is a felony. See? They can get you under anything. It's like the general article in the ucmj.
