Sacramento, CA -- Americans for Safe Access say the Compassionate Use Act, is a big victory for Medical Marijuana patients.
According to the organization more than eight years after Californian's voted for the Compassionate Use Act (CUA), allowing people to use marijuana medically, local law enforcement remains defiantly “confused” about which law to uphold, state or federal. They say that because of the reluctance by California Attorney General Bill Lockyer to clarify the issue for local police, a “culture of resistance” to enforcing state law has been allowed to fester.
A glimmer of hope, seen by many supporters as a big victory, is a statement made by Lockyer in a recent brief to the First District of the California Court of Appeals.
Where Lockyer dismissed the entire federal law argument of a patient whose medicine was confiscated, he said the continuing prohibition of marijuana possession under federal law.
